Chapter 2 first contains a number of general principles for assessing the exchange of information that apply to all types of horizontal cooperation agreements involving the exchange of information. The following chapters of these guidelines deal with a certain type of horizontal cooperation agreement. In each chapter, the analytical framework described in Section 1.2 and the general principles of information exchange apply to each type of cooperation. The R and Restrict the competition sought when they do not really concern joint research and development, but serve as an instrument to exploit a disguised cartel, i.e. the otherwise prohibited pricing, the limitation of production or the distribution of the market. However, an agreement on D, which involves sharing any future results, is not necessarily restrictive of competition. As long as participation in the effective definition of standard conditions for competitors in the market in question (either by participation in the trade association or directly) is full and the standard conditions set are not binding and accessible to all, these agreements should not have any restrictive effects on competition (subject to the reservations exposed to points 303, 304, 305 and 307). Electrical cables play an important role in the transmission and distribution of electricity. They can be placed underwater or underwater (under-sea cables) and are either low voltage, medium voltage or high voltage/high voltage.2 Although they are sold as separate products, Electrical cables are proposed in practice as part of a larger „project“ including the cable itself, its installation, its accessories and its maintenance services.4 The European Commission has initiated proceedings against a number of companies involved in the supply of such high voltage/extra-voltage cable projects, based on an immunity application brought by ABB. The investigation5, which led to the infringement decision of April 2, 2014, resulted in several companies conspiring to award projects and not be directly competing. In particular, the Commission found that the allocation agreements concerned „all types of land cables with a voltage of 110 kV or more, as well as all types of under-sea electrical cables with a voltage of 33 kV or more, including all products, factories and services provided to customers in connection with the sale of electrical cables when these sales were part of an electrical cable project“. 6 Marketing agreements can lead to significant efficiencies.
